Risk Management
We take a preventative approach as part of a continuing effort to minimize those opportunities where the ownership could be exposed to claims and legal action based upon negligence.
General Liability
We undertake a comprehensive Safety and Security Survey including the interior and exterior of the property to determine any opportunities for hazards that could cause resident injury or present security vulnerabilities. Once identified, we inform the owner of the specific nature of any deficiency outlining a recommended corrective course of action which we are prepared to implement.
Should any liability-related incidents occur, all Site Managers are trained to follow procedures to insure that all facts are accurately gathered and reported to the property’s liability insurance carrier, and that any necessary corrective actions are taken promptly.
With this system in place, the property’s liability insurance carrier is placed in an enhanced position to represent and defend, if necessary, the interests of the owner. We are always prepared to work closely with the attorneys assigned by the insurance carrier in this effort.
Contractor Liability
All contractors are required to meet established insurance coverage and limit requirements (liability, fire, worker’s compensation, automobile, excess liability) in order to protect the interests of the owner should physical damage or liability exposure occur as a result of a contractor’s activity.
Should damage occur to the buildings, equipment, and grounds of the property, we would promptly report such occurrences to the owner and advise the property insurance carrier as authorized by the owner. In respect to damage appraisal, we often utilize the services of an independent public adjuster who is contracted to work closely with the insurance carrier’s assigned adjuster to ensure that the owner’s interests are well protected during the claim process
Employment Liability
We have secured Employment Practices liability insurance providing coverage protection and legal defense service pertaining to wrongful employment practice claims (i.e. termination, discrimination, discipline). We provide our supervisory staff with ongoing training regarding personnel practices that minimize the opportunities for such claims and the proper notification and reporting of such claims should they occur.
We also provide Employee Dishonesty and Depositor’s Forgery coverage for the loss of money, securities, and other property caused by the dishonest acts of employees in the amount of $1,000,000. We have never had a claim against this policy.
We conduct extensive pre-employment screening reviews of all finalist applicants for available positions performing work for our properties. This screening review consists of the completion of an extensive application form, interview process as well as reviews and checks for employment history, criminal record, credit to verify Social Security number and address, military service, driving record, prior training and education/professional license.
